A restaurant owner in Italy, was slapped with a fine after being accused of failing to notify customers that its food was frozen, according to court documents.

The court in Milan, ruled that restaurants must label frozen food items as such so that customers should not falsely believe they are getting fresh food

The legal battle began when a restaurant owner was slapped with a $200 fine for commercial fraud.

Inspectors issued the fine after noticing frozen food in the freezer of the restaurants, but the menu failed to mention that to customers.

The restaurant owner appealed the fine, saying that there were no customers at the facility at the time, but the court upheld the decision, saying that failing to label food as frozen constitutes commercial fraud.

The court also increased the restaurant owner's fine form $200 to $2,000. Those found guilty of serving frozen food to unsuspecting customers, can get large fines or even jail time.
